Privacy Policy.

CreativeSoul Photography ("CreativeSoul," "we," "us," or "our") operates creativesoulphoto.com and the related booking, gallery, and store pages (the "Site"). This policy explains what personal information we collect, why we collect it, who we share it with, and the choices you have.

1. Who We Are

We are the business responsible for the personal information described in this policy.

2. Information We Collect

2.1 Information You Give Us Directly

Inquiry and contact forms. When you submit an inquiry, we collect your name, email address, phone number, and whatever you tell us about your session: the type of shoot you want, your preferred dates, the number and ages of the people being photographed, your location, your budget range, and any notes you add.

Booking and scheduling. When you book a session, we collect your name, email, phone, session date and time, session type, and any intake answers you provide, including wardrobe sizes, styling preferences, and information relevant to producing your shoot.

Contracts and agreements. When you sign a session agreement, model release, or licensing agreement, we collect your signature, the signing date, your billing address, and the terms you agreed to.

Payments. When you pay a retainer, session fee, or product order, our payment processor collects your card or bank details directly. We do not store full payment card numbers on our systems. We receive a record of the transaction: amount, date, last four digits of the card, and payment status.

Email list signup. When you join our mailing list or download a guide, we collect your email address, your first name if you provide it, and the source of the signup.

Store and print orders. When you order prints, albums, digital files, or other products, we collect your name, email, phone, shipping address, billing address, and order contents.

Direct messages and correspondence. If you email us, message us on social media, or use a chat widget on the Site, we keep a record of that conversation.

2.2 Information Collected Automatically

When you visit the Site, our hosting provider may record basic server-log information needed to deliver and protect the Site, such as your IP address, browser and device information, requested page, referring page, and request time.

The Site does not currently run Google Analytics, Meta Pixel, ManyChat's website widget, or another analytics or advertising tracker. We do not currently collect Site-based scroll depth, form-start, advertising-pixel, or cross-site retargeting data. When you submit a form, the information you choose to provide is sent to the service identified in this policy.

2.4 Information About Children

Much of our work involves photographing children. When a parent or legal guardian books a session, we collect information about the child being photographed, including first name, age or date of birth, clothing and shoe sizes, and any details the parent shares that are relevant to the shoot.

We collect this information from the parent or guardian, not from the child. Our Site is not directed to children under 13, and we do not knowingly allow children under 13 to create accounts, submit forms, or make purchases on the Site. If you believe a child has submitted information to us directly, email studio@creativesoulphoto.com and we will delete it.

We do not sell your personal information for money. The Site does not currently use advertising pixels or cross-site tracking. If that practice changes, we will update this policy and provide the required notice and choice before the technology is activated.

4. Photographs and Image Use

Photographs of you or your child are personal information, and we treat them that way.

How we use images. We use session images to deliver your gallery and products, and to promote the studio, but only within what your signed agreement allows. Your session agreement and model release govern whether we may use your images publicly.

Where images may appear. Where you have granted permission, images may appear on our website, in printed and digital marketing, on our social media accounts, in our portfolio and books, in submissions to publications and awards, and in advertising campaigns.

Withdrawing permission. You may withdraw permission for future public use of your images at any time by emailing studio@creativesoulphoto.com. We will stop using those images going forward and remove them from our website and our own social accounts within 30 days where we control the placement. We cannot recall images from printed materials already distributed, from third-party publications, from press coverage, or from copies other people saved or reshared.

Image storage. Session files are stored on our production systems and backup services. Delivered galleries are hosted with our gallery provider and remain available for the period stated in your agreement.

5. Who We Share Information With

We share personal information with service providers who help us run the studio. Each is bound to use the information only to provide services to us.

We may keep information longer where we have a legal obligation to do so, or where it is needed to establish or defend a legal claim.

7. Your Choices

Email. Every marketing email includes an unsubscribe link at the bottom. Unsubscribing stops marketing email. It does not stop transactional messages about a session you have booked, such as reminders, contracts, invoices, and gallery links.

Text messages. If you opted into text updates, reply STOP to any message to opt out.

Cookies and tracking. Use the cookie banner on the Site to accept or decline non-essential cookies. You can also change your preference at any time through the "Cookie Settings" link in the Site footer, and you can block or delete cookies in your browser settings. See our Cookie Policy for details.

Targeted advertising. The Site does not currently use advertising pixels or build retargeting audiences. You can still use the privacy and advertising controls offered by any social platform where you interact with CreativeSoul.

Your account and records. Email studio@creativesoulphoto.com to request a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. We will respond within 45 days.

8. California Privacy Rights

If you are a California resident, the California Consumer Privacy Act as amended by the CPRA gives you the following rights.

Right to know. You can request the categories and specific pieces of personal information we have collected about you, where we got it, why we collected it, and who we shared it with.

Right to delete. You can request that we delete the personal information we collected from you, subject to exceptions such as completing a transaction, complying with a legal obligation, or defending a legal claim.

Right to correct. You can request that we correct inaccurate personal information.

Right to opt out of sale or sharing. We do not sell personal information for money. The Site does not currently use advertising cookies or pixels to share Site activity for cross-context behavioral advertising. If we activate that technology later, we will provide the required notice and opt-out. You may also email studio@creativesoulphoto.com with the subject line "Do Not Sell or Share My Personal Information."

Right to limit use of sensitive personal information. We do not use or disclose sensitive personal information for purposes beyond providing our services.

Right to non-discrimination. We will not deny you service, charge you a different price, or provide a lower quality of service because you exercised any of these rights.

Categories collected in the past 12 months. Identifiers, customer records, commercial information, internet activity information, approximate geolocation, audio and visual information, and inferences drawn from the above. Sources, purposes, and recipients are described in Sections 2, 3, and 5.

How to submit a request. Email studio@creativesoulphoto.com with the subject line "California Privacy Request." We will verify your identity by matching the information in your request against our records, and we may ask for additional information if we cannot verify you from what you provide. An authorized agent may submit a request on your behalf with written permission signed by you.

9. Other State Privacy Rights

Residents of states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and Montana, have rights to access, correct, delete, and obtain a portable copy of their personal information, and to opt out of targeted advertising. Submit a request to studio@creativesoulphoto.com. If we deny your request, you may appeal by replying to our response with the subject line "Privacy Appeal." We will respond to an appeal within 45 days.

Georgia does not currently have a comprehensive consumer privacy law. We extend the access, correction, and deletion rights described above to all of our clients regardless of where they live.

10. Security

We protect personal information with access controls, encrypted connections on the Site, encrypted storage for client files, multi-factor authentication on our business accounts, and limits on which team members can access client records. Our vendors maintain their own security programs.

No system is perfectly secure. If we become aware of a breach affecting your personal information, we will notify you and any required authorities as the law requires.

11. Third-Party Links

The Site links to third-party services including our booking system, our store, our gallery provider, and our social media accounts. Once you leave our Site, this policy no longer applies. Read the privacy policy of any site you visit.

12. Changes to This Policy

We may update this policy as our business, tools, or the law changes. The "Last updated" date at the top reflects the most recent version. If we make a material change, we will post a notice on the Site and, where appropriate, email clients on our list. Continuing to use the Site after a change means you accept the updated policy.
